- Illegal hiring/ promotion
- Sexual Harassment

- Family Medical Leave Act (FMLA) claims
- Wrongful termination / retaliatory termination
Who Can File a Class Action Lawsuit?
Not every case can be filed as a class action. A class action is the best means only when it creates a more efficient and fair settlement or trial. In order to bring a class action, you must meet four elements:
- "Numerosity": A group of people so large that joining all members of a class in a lawsuit would not be practical
- "Commonality": At least one common issue that affects a substantial number of the people in the proposed class
- "Typicality": Your class representatives' claims must be typical of what the class members experience
- "Adequate representation": The class representatives and their counsel must be able to affectively represent the class (no conflicts of interest)
Getting the Best Class Action Settlement Possible
Many class actions end in settlement. When the numbers are stacked against employers, it is more difficult for them to win in court. Kaplan & Associates will aggressively negotiate for the best settlement possible. If the employer is not offering an acceptable settlement, we will take them to court.
